At QSZ Certification Services LLC (“QSZ”, “we”, “us”, or “our”), these Terms and Conditions establish the contractual framework governing access to and use of our website and the provision of certification, audit, inspection, training, and related conformity assessment services. These Terms reflect internationally accepted practices commonly adopted by accredited certification bodies and are designed to ensure transparency, impartiality, confidentiality, and legal clarity.
By accessing our website or engaging QSZ services, you agree to be bound by these Terms and Conditions.
1. Scope and Applicability
These Terms and Conditions apply to:
- All visitors and users of the QSZ website
- All clients requesting or receiving services from QSZ
- All quotations, proposals, agreements, certificates, reports, and deliverables issued by QSZ
Where specific contractual terms are agreed in writing, those terms shall prevail over these general Terms and Conditions in case of conflict.
2. Nature of Services
QSZ provides independent third-party conformity assessment services, including certification, audit, inspection, training, and assessment activities.
- Services are performed based on objective evidence and applicable standards
- Certification confirms conformity at the time of assessment only
- QSZ does not guarantee continued compliance, operational performance, or business outcomes
3. Client Obligations
The Client shall:
- Provide accurate, complete, and timely information required for service delivery
- Grant access to facilities, personnel, records, and sites as necessary
- Inform QSZ promptly of any significant changes affecting certification or service scope
- Comply with applicable laws, regulations, and certification requirements
Failure to meet these obligations may result in suspension, withdrawal, or termination of services.
4. Use of Certificates, Marks, and Reports
- Certificates and marks may be used only in accordance with QSZ rules and applicable scope
- Misuse, misleading statements, or unauthorized reproduction is strictly prohibited
- Reports are issued for the Client’s internal and agreed external use only and shall not be altered
QSZ reserves the right to take corrective action, including suspension or withdrawal of certification, in cases of misuse.
5. Confidentiality
- QSZ treats all non-public information obtained during service delivery as confidential
- Disclosure may occur only where required by law, accreditation requirements, or contractual obligation
- Clients shall maintain confidentiality of QSZ intellectual property, methodologies, and reports
6. Impartiality and Independence
QSZ operates with strict impartiality and independence in accordance with applicable conformity assessment standards.
- Certification decisions are free from commercial, financial, or other undue influence
- QSZ does not provide consultancy that could compromise impartiality
Clients shall not attempt to influence auditors, assessors, or certification decisions
7. Fees and Payment Terms
- Fees are defined in the agreed quotation or contract
- Invoices shall be paid within the agreed payment period
- QSZ may suspend services or certification in case of non-payment
- All applicable taxes, duties, or charges shall be borne by the Client unless stated otherwise
8. Limitation of Liability
- QSZ shall not be liable for indirect, incidental, or consequential losses
- Total liability shall not exceed the fees paid for the specific service giving rise to the claim
- Certification does not replace regulatory approval, due diligence, or risk management obligations
9. Suspension, Withdrawal, and Termination
QSZ may suspend, withdraw, or terminate services or certification in cases of:
- Non-compliance with requirements
- Misuse of certificates or marks
- Failure to meet contractual or payment obligations
- Legal or regulatory constraints
Clients may terminate services subject to contractual notice requirements and settlement of outstanding fees.
10. Complaints and Appeals
QSZ maintains documented and impartial procedures for handling complaints and appeals.
- Complaints and appeals may be submitted without fear of retaliation
- All cases are reviewed objectively and confidentially
- Decisions are communicated in a transparent and timely manner
11. Force Majeure
QSZ shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, governmental actions, epidemics, labor disputes, or other force majeure events.
12. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
13. Amendments
QSZ reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the QSZ website and shall take effect upon publication.
